More HK Arbitral Institutions Now Covered Under Cross-Border Relief Arrangement"},"content":{"rendered":"\r\n<p>In cross-border arbitration, timing is everything \u2014 especially when there\u2019s a risk that assets might vanish before a final award is handed down.<\/p>\r\n<p>Interim measures, such as injunctions or preservation orders, serve as a critical tool to safeguard parties\u2019 positions during the arbitral process.<\/p>\r\n<p>Thanks to a recent update, parties arbitrating in Hong Kong now have more institutional options when seeking interim relief from PRC courts.<\/p>\r\n<p>On 2 April 2025, the <a href=\"https:\/\/www.doj.gov.hk\/en\/mainland_and_macao\/pdf\/arbitration_interim_e.pdf\" target=\"_blank\" rel=\"noopener\">Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the HKSAR (the \u201c<strong>Arrangement<\/strong>\u201d)<\/a> added three more arbitral institutions to its whitelist.<\/p>\r\n<p>That brings the total to nine institutions where parties can apply directly to Mainland courts for property preservation, evidence preservation, and conduct preservation.<\/p>\r\n<p><strong>A Quick Refresher: What is the Arrangement?<\/strong><\/p>\r\n<p>On 2 April 2019, the Hong Kong SAR government and the PRC Supreme People\u2019s Court signed the Arrangement.<\/p>\r\n<p>In short, the Arrangement enables courts in both jurisdictions to grant interim relief \u2014 such as injunctions, asset freezes, or evidence preservation orders \u2014 to support arbitrations seated in other jurisdictions. This means:<\/p>\r\n<ul>\r\n<li>If your arbitration is seated in Hong Kong, you can apply directly to Mainland courts for interim measures.<\/li>\r\n<li>If your arbitration is seated in Mainland, you can seek relief from the Hong Kong courts under local law.<\/li>\r\n<\/ul>\r\n<p><strong>Who Qualifies?<\/strong><br \/><br \/>Article 2 of the Arrangement restricts its application to arbitral proceedings seated in Hong Kong and administered by:<\/p>\r\n<ol>\r\n<li>arbitral institutions established in the HKSAR or having their headquarters established in the HKSAR, and with their principal place of management located in the HKSAR;<\/li>\r\n<li>dispute resolution institutions or permanent offices set up in the HKSAR by international intergovernmental organizations of which the People\u2019s Republic of China is a member; or<\/li>\r\n<li>dispute resolution institutions or permanent offices set up in the HKSAR by other arbitral institutions and which satisfy the criteria prescribed by the HKSAR Government (such as the number of arbitration cases and the amount in dispute, etc).<\/li>\r\n<\/ol>\r\n<p>Article 2 further stipulates that the HKSAR Government and the Supreme People\u2019s Court would jointly confirm the list of such institutions or permanent offices.<\/p>\r\n<p><strong>Latest Development<\/strong><\/p>\r\n<p>The approved list is reviewed every two years. The <a href=\"https:\/\/www.doj.gov.hk\/en\/community_engagement\/announcements\/pdf\/Interim_Measures_Arrangement_Contact_Details_of_Arbitral_Institutions_en.pdf\" target=\"_blank\" rel=\"noopener\">updated list<\/a>, effective from 2 April 2025, now includes the following nine arbitral institutions (newest additions in bold):<\/p>\r\n<ul>\r\n<li>Hong Kong International Arbitration Centre<\/li>\r\n<li>Hong Kong Maritime Arbitration Group<\/li>\r\n<li>South China International Arbitration Center (HK)<\/li>\r\n<li>eBRAM International Online Dispute Resolution Centre<\/li>\r\n<li><strong>Shanghai International Arbitration Center<\/strong><\/li>\r\n<li><strong>Asia Pacific Investment Arbitration Centre<\/strong><\/li>\r\n<li><strong>AALCO Hong Kong Regional Arbitration Centre<\/strong><\/li>\r\n<li>China International Economic and Trade Arbitration Commission Hong Kong Arbitration Center<\/li>\r\n<li>Secretariat of the International Court of Arbitration of the International Chamber of Commerce \u2013 Asia Office<\/li>\r\n<\/ul>\r\n<p><strong>Applying for Interim Measures in Hong Kong Courts<\/strong><br \/><br \/>Where arbitral proceedings are seated in the Mainland (or other jurisdictions outside of Hong Kong), parties may apply to the Hong Kong Court of First Instance (CFI) for interim relief under the Arbitration Ordinance (Cap. 609) and the High Court Ordinance (Cap.4).<br \/><br \/>Under Section 45(2) of the Arbitration Ordinance, on application of any party, the court may, in relation to arbitral proceedings commenced or to be commenced in or outside Hong Kong, grant an interim measure. The purpose of this is often to facilitate the work of a tribunal outside Hong Kong that has primary jurisdiction over the arbitral proceedings (Section 45(7)(b)). This complements the broader judicial framework under the High Court Ordinance which allows for powerful remedies such as Mareva injunctions (\u8cc7\u7522\u51cd\u7d50\u4ee4) and Anton Piller orders (\u5bb9\u8a31\u67e5\u5bdf\u4ee4).<br \/><br \/>As highlighted in our previous article on <a href=\"https:\/\/hauzen.hk\/so-what-exactly-are-interim-interim-injunctions\" target=\"_blank\" rel=\"noopener\">interim-interim injunctions<\/a>, the Hong Kong court is prepared to grant urgent interim relief when it is just and convenient to do so. In the recent case of <em>Company A and Another v. Company C<\/em> <a href=\"https:\/\/legalref.judiciary.hk\/lrs\/common\/ju\/ju_frame.jsp?DIS=165044&amp;currpage=T\" target=\"_blank\" rel=\"noopener\">[2024] HKCFI 3505<\/a>, the CFI granted a Mareva injunction and other relevant reliefs to facilitate the tribunal and preserve the status quo pending the Tribunal\u2019s ruling and the issuance of the final award.<br \/><br \/><strong>Implication of the Latest Development<\/strong><br \/><br \/>The expanded list of qualified institutions under the Arrangement reinforces Hong Kong\u2019s position as a trusted venue for international arbitration involving Mainland parties.
